Reckless St Killian’s driver jailed

A ST KILLIAN’S High School driver who was last year involved an accident that killed three people – two of them pupils who were off the road going to school – was on Monday convicted and slapped with three years in jail.

Nyasha Peter Dhliwayo (45), who was a self actor, was convicted on his own plea of guilty to culpable homicide.

He will, however serve two effective years in jail after Rusape magistrate Ms Patience Ururu-Madondo suspended 12 months on condition of good behaviour. Ms Madondo also barred Dhliwayo from driving for the next 12 months.

Prosecutor Mr Gift Mutigwa told the court that Dhliwayo drove a St Killian’s High truck negligently by speeding and failed to act reasonably when an accident seemed eminent. He failed to keep a proper look out under the circumstances.

“On October 12, 2018 around 6:30am, Dhliwayo was driving a white Toyota Hilux along the Rusape-Nyanga highway with some passengers on board. Upon approaching the 3km peg towards Rusape (Grace Fellowship Church), he lost control of the vehicle, swerved to the right and hit on the opposite lane two pedestrians who died on the spot while one passenger who was on board also died on spot.

“Three other passengers including the accused person were seriously injured. The vehicle was extensively damaged and was examined by VID department,” said Mr Mutigwa.

Though Dhliwayo showed contrition and begged the court to be lenient with him, Ms Madondo did not lose sight of gravity of the offence.
