A 21-year-old Mutare man who used phone applications to generate fake transaction confirmations, was spared from a four-month jail term after magistrate Prisca Manhibi set the sentence aside on condition that he restitutes the complainant.
Aleck Kadungure had been sentenced to seven months on which three months were suspended on condition of good behaviour for five years.
The remaining four months were suspended on condition that he restitutes $15 dollars to the complainant on the first count.
Prosecutor Mr Nyasha Mukonyore prosecuted.
The fraud charges all occurred on the same day, May 15 this year when the accused first approached Tendai Kapfumvuti of Dangamvura and made a fake Ecocash transaction of $ 15 for transport fee.
The complainant checked his mobile and found no transaction done but the accused had already gone after presenting an edited Ecocash message.
A few hours later the accused duped a vendor, Pamela Munotsva who resides in Hobhouse.
He went to her work place, and pretended wanting to buy clothes, he got four shorts and two t-shirts.
Using the same trick, he paid the bill using Ecocash and later the complainant found out there was no transaction done.
He went away with $180.
He moved on to another vendor where he duped him of $134 in exchange for three pairs of trousers.
Upon reaching Perfect Mutengo’s work place, he got three pairs of shoes and $45 cash.
He attempted to do the same trick but the complainant this time asked him to wait for the confirmation and that is when he left his phone and ran away.
Mutengo tracked him down and alerted the police that were patrolling nearby and was immediately arrested. All the complainants recovered their belongings except Kapfumvuti.
