A SAKUBVA man tried to use his illness to evade paying more money for the upkeep of his child.

Nyasha Machengo recently dragged her ex-husband, Gift Chioneso, to Mutare Civil Magistrate Court as she applied for an upward review of her child’s maintenance from US$10 to US$200.

Mutare magistrate, Mr Xavier Chipato presided over the matter and reviewed the maintenance to US$30.

The court took into consideration the fact that Chioneso is not working and that he is a TB patient on treatment.

Machengo said she is finding it difficult to take care of her minor child alone as she is a vendor who realises US$60 per month.

This amount, she said, cannot cover for rentals, food and clothing for both her child and herself as all this chews up almost US$160 per month.

She said she separated with Chioneso after he lied that she was having an affair.

The matter spilled into the community court where it was ruled that Chioneso should take Machengo back to her parents’ home, which he did.

Chioneso said he is not working and his mother is providing him with food, clothing as well as shelter.

He said he is prepared to have custody of the child.

 

However, this idea was shot down by the magistrate since the child is still a minor.
