A MUTARE woman has pleaded with the court to evict her nephew as she accuses him of tormenting, harassing and intimidating her.
Jessica Mbiragai appeared before Mutare magistrate, Ms Ivy Musavengana applying for a protection order against her nephew, Kelvin Nyamunda, whom she said is violent.
Mbiragai said she is now living in fear of her violent nephew. She said Nyamunda should be evicted from their family house as he is now an adult capable of looking after himself.
“I started staying with Kelvin when he was doing his primary education. He is now 32 and has since completed his tertiary education. He is now a grown up and should be independent, just like any other grown up person,” said Mbiragai.
She added: “I cannot reprimand him for any wrong-doing as he is of a violent predisposition. He feels that he is now a big man that should not be challenged.”
Mbiragai said Nyamunda also assaults and forces her to cook for him.
“I had decided not to cook for him as he is now an adult, but have since started doing so following his threats. l am sharing the same roof with a monster. He is a law unto himself and he messes the toilet and leaves it like that. I am always forced to clean the mess. I am fed up and I want peace in the house,” said Mbiragai.
She added: “Today I will have to find alternative accommodation after this court session because l know he will assault me for dragging him to court. My life is in danger. I don’t think the protection order will be enough, I want him evicted from the house.”
However, Nyamunda denied the allegations. He said he has never assaulted, threatened or insulted Mbiragai.
“She is just looking for a way to chuck me out of the house. I have never harmed or threatened her. I have nowhere to go if I am evicted from the house. I was born and grew up staying in that house. I am no longer eating her food as she despises me,” said Nyamunda.
Ms Musavengana granted the protection order in Mbiragai’s favour.
The protection order is valid for two years and bars Nyamunda from harassing, insulting and intimidating Mbiragai.
