THE son of the late Mutare property mogul, Mr Pius Mutyasira, Derron Mutyasira who was arrested for fraudulently altering his deceased father’s estate documents to deprive more than 40 of his siblings is out on US$200 bail.
As part of the bail conditions, Mutare magistrate, Ms Anne Ndiraya ordered DerronMutyasira (41) and his accomplice, Progress Mundondo (38), to continue residing at their given addresses, not to interfere with State witnesses, to deposit US$200 apiece with the Clerk of Court in Mutare as well as to report at Mutare Central Police Station every fortnight on Fridays.
Derron and Progress are friends.
The two appeared before Ms Ndiraya, facing three counts of fraud.
The duo was remanded to February 19.
The court heard that the duo connived, on three separate occasions, to submit fraudulently altered estate documents to the Master of High Court in an attempt to grab the properties for personal benefit.
Prosecutor, Mr TinotendaMuzondo told the court that on July 23, 2023, Derron and Progress hatched a plan to fraudulently inherit a property from the estate of the late Mr Mutyasira.
The court heard that Derron, who had particulars of his late father, connived with Progress to craft a fraudulent Deed of Donation in respect of Stand Number 3355A, Umtali Township, measuring 3 120 square metres.
The property is held under Deed Number 0002623/2007 and in the fake documents, the duo purported that the late Mr Mutyasira had donated the property to Derron.
The two accused submitted the documents to the Master of High Court.
It is alleged that on September 22, 2023, the two accused hatched a plan to fraudulently inherit another property from the estate of the late Mr Mutyasira.
Using the same method, the duo allegedly submitted fraudulent documents to the Master of High Court purporting that late Mr Mutyasira had donated Stand Number 106, Avondale West of Lot 21 Block, measuring 793 square meters, to Mrs FigueiredoSheron Michelle nee Mutyasira.
On September 28 last year, the two accused persons allegedly created a fraudulent agreement of sale of Stand Number 3431, Umtali Township of Mutare, measuring 3 124 square meters, purporting that the late Mr Mutyasira had sold the property to Ms Villa TanyaradzwaMutyasira.
The two allegedly submitted their fraudulent documents to the Master of High Court.
The deceased businessman had more than 40 children, six of whose mothers have already registered their interests with the Master of High Court.
