AN ELDERLY Marange man last week dragged his neighbour to court for trespassing and cutting down trees in his field.
Elliot Huhuyani and Obert Chitsiku appeared before Mutare magistrate, Miss Nyasha Kuture, with the former praying for protection against the latter whom he accused of intimidating him with catapult several times over a land dispute.
Huhuyani told the court that he was now fearing for his life.
The court heard that the land in question was once a centre of dispute which was resolved at the traditional courts some years back.
However, Huhuyani won the matter and was awarded the land, but Chitsiku’s children still claim that the land belongs to them.
“I have letters from the traditional leaders’ court stating that the land is mine, but Chitsiku still trespasses into my land claiming that the land belongs to his father. He cut all the fruit trees in my field to feed his cattle.
“I now feel insecure since he is in the habit of intimidating me using catapult, several times. I now need the court’s intervention so that this young man stops trespassing into my land. He is capable of doing anything now,” said Huhuyani.
In response, Chitsiku disputed the allegations levelled against him. He told the court that Huhuyani’s field was fenced.
“Nobody has access to this man’s land since it is fenced. Where can I get the guts to insult and intimidate him when he actually boasts around that he is the one who killed my father? I am also afraid of him Your Worship,” said Chitsiku.
He told the court that he had no problem if the order was granted as it also saves him from all these allegations.
Miss Kuture granted the order in favour of Huhuyani.
