A Mutare man has approached the courts seeking a protection order against his brothers.

Appearing before Mutare magistrate, Mr Xavier Chipato, Francis Zuze said his brothers, Farai Zuze and Tinashe Elvis Tichaona, are jealous that he bought a car.

He said his two brothers are now interfering with his work and threatening to assault him if he refuses to drive them in his car.

“They are jealous of me because I have a car when they do not have one. They always want me to drive them to places of their choice even if I am busy with other things,” he said.

He said at one time, Tinashe struck him with an iron bar and he had to be hospitalised.

The assault matter is still pending before the Mutare Magistrates’ Court.

“Farai says I cease to be his relative once I deny him access to my car whenever he wants it.

“He challenges me as if I am younger than him, yet I am the older brother. He wants me to keep looking after him as if he is still a minor, but I did all I could to educate him before he became a major,” he said.

Francis was seeking a protection order that bars his brothers from visiting him at his home.

In response, Farai rubbished his elder brother’s claims and stated that he is capable of taking care of himself.

“I am 33 and can take care of myself. That is what I have been doing all along and for him to allege that I am forcing him to take care of me is a blatant lie.

“Also I do not think it will be thoughtful for the court to bar me from visiting Francis because my late son’s grave is in his yard.

“I want to visit that grave so I should not be barred,” he said.

He further stated that he is actually happy that his brother owns a vehicle which eases transport woes within their family.

“How can I be jealous that my brother has a car? His car is family property. I am happy with his success,” he said.

Tinashe also claimed that he is not jealous of Francis.

 

He, however, confirmed that he has a pending assault matter before the courts after he assaulted Francis.

“He is the one who is actually violent towards me. He claims that I want to kill him and accuses me of siding with Farai in their feuds,” he said.

Mr Chipato granted the protection order in favour of Francis.

 

The order will be valid for a year and it bars the two men from visiting Francis with the intention of insulting, assaulting, harassing and disturbing his peace.
