Farm workers attach property

THIRTY Rusape farm workers who are owed over $10 000 in salary arrears will have to wait a little longer to get their dues after the Messenger of Court was stopped from auctioning attached farm equipment until actual ownership is ascertained.
Robert Smart, the proprietor of Lesbury Farm in Nyazura who is represented by Mr Leonard Chigadza of Chigadza and Associates, filed an urgent application at the Rusape Civil Court arguing that the attached tractors and a vehicle belong to a partnership he is in with another farmer, Mr Deon Bekker.

The farm workers who won at the labour court enlisted the services of the Messenger of Court to recover $10 579 and the latter attached two tractors and a Mazda BT50 vehicle.

Smart, who is not denying owing the workers their dues, said the Messenger of Court must have attached his own property, not that of his partner, Mr Bekker.

“The attached property does not belong to me, the judgment debtor. It belongs to Lesbury Estates (Pvt) Ltd, who have ceded their rights to Khamango Enterprises (Pvt) Ltd. As per our joint venture agreement we have submitted Mr Deon Bekker as director of Khamango Enterprises.

The farm workers, who were cited as respondents, are not represented.
Rusape magistrate Mrs Petronella Hanzi adjourned the matter to August 25.
