A RUSAPE man, who was caught red-handed allegedly raping a mentally-challenged woman in Rusape’s Central Business District in April, has been arrested and hauled before the courts to answer the charges.

Forty-year-old Joseph Jerahuni was caught by security guards around 12 midnight abusing the 32-year-old woman at a shop veranda. The shop is about 150 metres from Rusape Central police station.

Jerahuni, who was denied bail at the Rusape magistrate courts, has since engaged Mr Walter Mangwende of Chiwanza and Partners to apply for bail at the Mutare High Court and the ruling is yet to be delivered.

According to the state outline, Jerahuni was spotted by security guards entering into the woman’s blankets and they pounced on him in the middle of the act. They handed him over to the police.

At law, a mentally-challenged person is incapable of consenting to sexual intercourse.

“The complainant is a mentally-challenged female residing at Zumbani Village in Gandanzara. On April 2018, 2019, at around 0030hrs, Jerahuni arrived at Rana Shop veranda where the complainant was in the blankets asleep.

“The accused person entered into the complainant’s blankets and proceeded to rape her. The accused person did his act in the view of Enerst Chaterera, a security guard at Omnia shop which is on the opposite side of Rana shop. Chaterera called a fellow security guard, Malvin Murinda, and approached the accused person whom they found on top of the complainant and arrested him. They took Jerahuni and the complainant to the police where the latter filed a report,” read the state outline.
