A MUTARE man allegedly attempted to rape his ex-wife in the presence of his children, claiming that as long she continues residing in his house, he can be intimate with her anytime.

Patricia Dhliwayo said her ex-husband stormed into her room and tried to be intimate with her, but she refused.

She ran into the lounge where her children were watching television to escape from her husband, Tendai Mangoyana.

“He came into my room and tried to be intimate with me, but I refused since he had made it clear that he wanted me out of his life for good. I was only staying there because he was yet to formalise the divorce.

 

“I ran to the lounge where my kids were watching television and he followed me there. He pushed me and tried to rape me in the presence of my children. He only stopped when I ripped his shirt,” said Dhliwayo.

This emerged at Mutare Magistrates Civil Court where the husband, Mangoyana, was applying for a protection order against his ex-wife, saying Dhliwayo is in the habit of insulting and assaulting him.

Mutare magistrate, Mr Xavier Chipato presided over the matter and granted the protection order in favour of Mangoyana.

Mangoyana said Dhliwayo is refusing to move out of his house, saying she will only leave in a coffin.

“She is threatening to kill herself in my house. She said she will not leave the house until I give her a divorce token as proof that it is over between us,” said Mangoyana.

He also said Dhliwayo also assaults and insults him saying he is a wizard.

“She says I am a wizard. She recently assaulted me. She grabbed me by the collar and tore my shirt and said I am still her husband and should be intimate with her,” said Mangoyana.

However, Dhliwayo denied this and said he was lying as she tore his shirt and pair of trousers as self-defence as Mangoyana was trying to rape her.

Mangoyana also said Dhliwayo is threatening to sell their matrimonial house, yet they had agreed that the house belongs to the children.

“We agreed that we will not sell the house as it is part of the children’s inheritance.

“She is threatening to sell the house, saying she also contributed to its construction, yet she didn’t. I bought the house and built it alone while she was at university. I was the one who was paying for her school and other related expenses,” he said.

Dhliwayo said she had vacated the house, but only went back there to collect her belongings.

She said she was also insulted by her ex-husband’s relatives.

Mr Chipato granted the protection order which bars the respondent from visiting the complainant for the purposes of disturbing his peace.
