Man sued for marriage wrecking Loveness Tavatya

A TAXI driver based in Chimanimani is facing US$20 000 adultery damages from two different men after allegedly wrecking their marriages.

In summons in possession of The Manica Post, Godfrey Kuretu was sued by Chimanimani businessman Abel Taura Manjeya for US$10 000

Kuretu was also sued for another US$10 000 by Joseph Simango at Mutare Civil Courts recently.

Both matters are being heard by Mutare magistrate, Mr Lazarus Murendo.

Kuretu has already been served with summons.

According to Manjeya in his particulars of claim, he said he was involved in a high speed chase with Kuretu after he found him in the company of his wife.

“On April 30, this year at around 1pm at Greenmarket robots the plaintiff (Manjeya) spotted the defendant driving to town with Manjeya’s wife and chased the vehicle and managed to block the way and caught his wife, Loveness Tavatya hiding at the back seat and a brawl ensued. Traffic police intervened and took both parties to Mutare Central Police Station,” reads Manjeya particulars of claim

“The plaintiff asked the defendant why he was with his wife and surprisingly alleged to have offered her a lift. This was during the presence of traffic police officers namely sergeants Sibanda, Venge and a lady officer.

“The defendant was again asked by police why he was in the company of the plaintiff’s wife Tavatya, and he changed his version and admitted to be in a long relationship with plaintiff’s wife and the wife also admitted to be in love with the defendant since 2007,” he said.

“The defendant was fully aware that plaintiff and his wife had a customary marriage that was in existence since defendant was my regular customer since l used to panel beat his vehicles at my house garage.

“The defendant was aware of the marriage but despite all this the defendant had an affair with the plaintiff’s wife,” he said

He said the affair had caused a lot of damage to plaintiff’s marriage.

Simango in his particulars of claim said that he found some love text messages in his wife’s mobile phone involving Kuretu who is his neighbour.

“On April 22, 2018, the plaintiff, Simango found some love text messages in his wife’s messages. Plaintiff confronted his wife Argitone Simango nee Mushuma and asked her about them which she confirmed that she was having an adulterous affair with the defendant Kuretu in front of her relatives and those of the plaintiff,” reads Simango’s particulars of claim.

“The defendant was fully aware that the plaintiff and spouse had a civil marriage that was in existence.

“Since the defendant and plaintiff are neighbours, they stay in the same village, the defendant was even present on plaintiff’s wedding but despite all this, the defendant had an affair with the plaintiff’s wife.

“Plaintiff is employed as a driver at Emmark Investments and most of the times he would be away from home because of work. Kuretu took advantage of the situation and engaged in an adulterous affair with plaintiffs wife,” reads Simango’s particulars of claim

Mr Murendo has ordered several witnesses to testify in both matters.

One of the matters will be heard in court on September 16.
