A MUTARE man is demanding back a residential stand that he allegedly surrendered as compensation for dating, impregnating and terminating the pregnancy of a married woman.

The man also allegedly deliberately infected the woman with HIV.

Shadreck Munapo and Bornwell Munapo appeared before Mutare provincial magistrate, Mr Langton Carter facing extortion charges as defined in Section 134 of the Criminal Law (Codification and Reform) Act, Chapter 9.23.

However, they denied the allegations and argued that Mapara Gumisai willingly surrendered the residential stand to Bornwell as compensation for his reckless behaviour.

 

They were remanded out of custody to September 16 for trial.

 

The total value of the residential stand is US$10 000 and nothing has been recovered yet. Mr Nyasha Gerald Mukonyora prosecuted. Mr Mukonyora said the Munapo brothers forced Gumisai to surrender his residential stand as compensation for his illicit affair with Bornwell’s wife.

The duo also allegedly threatened to fix Gumisai with juju if he failed to pay for having the affair and allegedly infecting Bornwell’s wife with HIV.

“On March 24 near Chidzere Bar in the Central Business District, Bornwell and Shadreck met with Gumisai to resolve the issue of his alleged affair with Bornwell’s wife. Bornwell demanded compensation for the suffering that the illicit affair had brought to him. Gumisai gave Bornwell US$200 but he refused to accept it saying it was peanuts,” said Mr Mukonyora.

During their meeting, Shadreck suggested that a residential stand be handed back to Bornwell as compensation.

Mr Mukonyora added: “Bornwell also threatened to consult a spiritual healer or to hire hooligans who would assault the complainant if he failed to comply with the demands.

“Gumisai then went with the Munapo brothers to a Commissioner of Oaths where they signed an agreement of sale of the residential stand,” said Mr Mukonyora.

It is alleged that Gumisai’s wife is the one who exposed her husband’s affair.

She allegedly tracked her husband’s phone activities and got to know about the lovebirds’ appointments.

The court heard that Gumisai impregnated Bornwell’s wife and connived with her to terminate the pregnancy.

However, the abortion went wrong and the woman had to be admitted at Victoria Chitepo Provincial Hospital where Gumisai settled her medical bills.

 

Gumisai, however, denied infecting Bornwell’s wife with HIV although he admitted that he is on anti-retroviral therapy.

Said Gumisai: “I did not deliberately infect her with HIV. We always used protection. However, on the day in question, the protection burst and there was nothing I could do about it. I messed up and I am willing to pay compensation, but only through proper channels.

 

“I did not pay for the medical bills as an admission that I had a hand in the termination of the pregnancy. Bornwell called pleading with me to assist in settling the medical bills. He said he would pay me back. I did this out of charity.”

Gumisai further stated that the Munopo brothers forced him to sign the agreement of sale for the residential stand, with his wife and brother witnessing this.

“Yes, I had a relationship with his wife and I am willing to pay for that but they should not take my property by force.

“They threatened to assault or bewitch me, so what was I supposed to do? I want my residential stand back,” charged Gumisai.

He also stated that his marriage is now shacking because of the infidelity issue.
