Councillor in maintenance wrangle

A Mutare Ward 17 councillor, John Nyamhoka, has been taken to court by his wife who is demanding maintenance for the upkeep of their six children.

The city father is being accused of neglecting the children despite him being financially sound to take good care of them.

Fortunate Musweweshiri said she finally resolved to approach the courts to get assistance because her husband was not heeding her repeated calls and pleas to look after his children.

The presiding magistrate Ms Nyasha Kuture granted Musweweshiri her claim and ordered Nyamhoka, who was in default, to pay $1 550 monthly as maintenance.

“Despite the fact that he is not in attendance, the court has seen that he has the means and properties to support his children, therefore he shall be ordered to do so. He shall pay the $1 550 for the six children until they are 18 years old or self-sufficient,” said Ms Kuture.

To support her claim Musweweshiri listed Nyamhoka’s properties to the court.

She told the court that her husband owned two houses, two residential stands and three cars.

She also told the court that Nyamhoka earned $8 000 monthly yet he is failing to spare a cent for his family though they were living under the same roof.

“Your Worship, he is financially stable to maintain his children. It’s just that he does not want to do so.

“We have two houses and a lot of residential stands. We also have three cars, a Beetle, a Mazda and a UD truck.

“Despite all that, my husband takes all the proceeds from all these properties and uses them for himself,” said Musweweshiri.

She told the court that she wanted to use $700 for groceries, $400 for the children’s school fees and $100 for transport.
