A MUTARE Bottling Company sales representative who was accused of stealing empty crates of soft drinks worth $2 500 together with an accomplice has been acquitted of the fraud charges.

Simbarashe Mhindo (34)  and his driver John Muzhandaka (47), appeared before  Ms Perseverance Makala.

They both denied the charges. Allegations were that they contravened Section 136 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.

Mhindo was acquitted of the charges last week Tuesday while his accomplice Muzhandaka was convicted.

Public Prosecutor, Mr Cuthbert Bhosha, told the court that on December 20, Mhindo who is a sales representative had secured an order of 807 crates of soft drinks from Mega Mart Foods in Hauna, Honde Valley.

He gave Muzhandaka, who is a driver, soft drinks to deliver to Mega Mart stores.

“After delivery, Muzhandaka only returned with 502 empty crates to Mutare Bottling Company Depot,” said Mr Bhosha.

It later emerged that Muzhandaka acted alone and sold the empty bottles of soft drink crates and converted the money to his own use.
